This privacy policy applies to the FishTools app (hereby referred to as the "Application") for mobile devices that was created by Wakeuplab OÜ (hereby referred to as the "Service Provider") as a Freemium service. This service is intended for use "AS IS".

Information Collection and Use

The Application collects information when you download and use it. This information may include information such as:

• Your device's Internet Protocol address (e.g. IP address)
• The pages or features of the Application that you visit, the time and date of your visit, and the time spent on those pages or features
• The time spent on the Application
• The operating system you use on your mobile device
• Crash, diagnostics, and performance data

The Application may also collect information that you provide directly, including your email address, country, notes, diary entries, map content, measurements, media, and other content you choose to submit in the Application.

The Application does not gather precise information about the location of your mobile device on a continuous basis without your permission. However, if you enable location-based features, the Application may collect your device's approximate or precise location data at the time you use those features.

The Service Provider may use location data in the following ways:

• Geolocation Services: to provide location-based features, personalized content, relevant recommendations, and map-related functionality.
• Analytics and Improvements: to analyze usage patterns, identify trends, and improve the performance and functionality of the Application.
• AI Insights: to generate contextual fishing insights and recommendations using anonymized or pseudonymized data such as time, approximate location, environmental context, and related usage signals.
• Third-Party Services: to transmit anonymized, aggregated, or pseudonymized data to service providers that help operate, improve, secure, and support the Application.

The Service Provider may use the information you provided to contact you from time to time to provide important information, required notices, service messages, account-related communications, and, where permitted by law, marketing communications.

For a better experience while using the Application, the Service Provider may require you to provide certain personally identifiable information, including but not limited to email, country, and device location. The information that the Service Provider requests will be retained by them and used as described in this privacy policy.

AI Features and Automated Processing

The Application may include AI-powered features that provide insights, recommendations, measurements, classifications, and other analysis based on user-provided or automatically collected data.

These AI-powered features may process the following categories of data:

• Approximate or precise location data, if you choose to enable location permissions
• Time and activity data associated with fishing sessions or Application usage
• User-generated content such as images, notes, diary records, measurements, and related metadata
• Device, diagnostics, and usage data needed to operate and improve the AI-powered features

• Generate fishing insights and recommendations
• Analyze fishing conditions and patterns
• Recognize fish species and estimate fish characteristics from photos
• Improve the quality, safety, performance, and reliability of the Application and its AI-powered features

Where reasonably possible, data used for AI processing is anonymized, aggregated, or pseudonymized before being sent to service providers or used for analytics and model improvement. AI-generated outputs are probabilistic and may be incomplete, inaccurate, or unavailable in some cases.

Image Processing and Fish Recognition

The Application may allow you to capture or upload images, including images of fish. These images may be processed using AI technologies in order to:

• Identify or estimate fish species
• Estimate fish length, width, weight, or similar characteristics
• Pre-fill diary or measurement fields for your review before saving

Images are processed solely to provide these features and to maintain, improve, and secure the related services. The Service Provider does not intend to use these images to identify you as an individual. Users are responsible for ensuring that uploaded images do not contain unnecessary personal data or sensitive information about themselves or others.

Profiling and Recommendations

When AI-powered recommendations are generated using location, time, environmental context, fishing records, or similar signals, that processing may be considered profiling under applicable law. The Service Provider uses this processing only to provide informational recommendations and improve the Application. The Application does not use automated processing to make decisions that produce legal effects or similarly significant effects on users.

Third Party Access

Only aggregated, anonymized, or pseudonymized data is periodically transmitted to external services to aid the Service Provider in improving the Application and their service. The Service Provider may share your information with third parties in the ways that are described in this privacy statement.

The Application utilizes third-party services that have their own privacy policies about handling data. The Application may also use third-party AI service providers, cloud hosting providers, analytics providers, diagnostics providers, and support tools to process data on behalf of the Service Provider.

These providers may process anonymized, aggregated, pseudonymized, or personal data strictly as needed to provide services to the Service Provider and in accordance with applicable data protection laws. The Service Provider does not intentionally share directly identifying personal information with AI providers unless it is necessary to provide a feature you request or otherwise permitted by law.

• Firebase Crashlytics
• Facebook
• AI, hosting, storage, and infrastructure providers used to deliver AI-powered features and backend services

The Service Provider may disclose User Provided and Automatically Collected Information:

• as required by law, such as to comply with a subpoena, court order, regulatory request, or similar legal process;
• when they believe in good faith that disclosure is necessary to protect their rights, protect your safety or the safety of others, investigate fraud, abuse, or security incidents, or respond to a government request;
• with trusted service providers who work on their behalf, do not have an independent right to use the information disclosed to them except as needed to provide services, and have agreed to handle the information consistently with this privacy policy and applicable law.

Retention of AI Inputs and Outputs

The Service Provider may retain AI-related inputs and outputs, including images, prompts, metadata, estimates, classifications, and generated insights, for as long as reasonably necessary to provide the feature, maintain records, detect abuse, troubleshoot issues, improve service quality, comply with legal obligations, and enforce agreements. Retention periods may vary depending on the type of data and the feature used.

Opt-Out Rights

You can stop all collection of information by the Application easily by uninstalling it. You may use the standard uninstall processes available as part of your mobile device or via the mobile application marketplace or network. Where available in the Application, you may also disable particular permissions such as camera or location access, and you may choose not to use AI-powered features.

Data Retention Policy

The Service Provider will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. If you would like them to delete User Provided Data that you have provided via the Application, please contact them at [email protected] and they will respond within a reasonable time, subject to legal, security, fraud-prevention, and legitimate business retention needs.

Children

The Service Provider does not use the Application to knowingly solicit data from or market to children under the age of 13.

The Application does not address anyone under the age of 13. The Service Provider does not knowingly collect personally identifiable information from children under 13 years of age. In the event the Service Provider discovers that a child under 13 has provided personal information, the Service Provider will delete this information from their servers as soon as reasonably practicable. If you are a parent or guardian and you are aware that your child has provided personal information, please contact the Service Provider at [email protected] so that they can take the necessary actions.

Security

The Service Provider is concerned about safeguarding the confidentiality of your information. The Service Provider provides physical, electronic, contractual, and procedural safeguards designed to protect information the Service Provider processes and maintains. However, no method of electronic transmission or storage is completely secure, and the Service Provider cannot guarantee absolute security.

International Processing

Your information may be processed in countries other than your country of residence, including by service providers that support hosting, analytics, diagnostics, customer support, and AI-powered features. By using the Application, you understand that your information may be transferred to and processed in such jurisdictions, subject to applicable safeguards required by law.

Changes

This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any material changes to the Privacy Policy by updating this page and, where appropriate, through the Application or other reasonable means. You are advised to review this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.
