These terms and conditions apply to the FishTools app (hereby referred to as the "Application") for mobile devices that was created by Wakeuplab OÜ (hereby referred to as the "Service Provider") as a Freemium service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or the Service Provider's trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted except to the extent such restriction is prohibited by applicable law. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider or its licensors.

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

The Service Provider may collect and process unpersonalized, anonymized, aggregated, or pseudonymized data that is derived from your use of the Application. This data is collected for the purpose of operating, securing, improving, analyzing, and developing the Application and its features, including AI-powered features. By using the Application, you agree that such non-personal data, including statistical or analytical information that does not identify you as an individual, may be used, shared, retained, and commercialized by the Service Provider without further notice to you or compensation to you.

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Doing so could make your phone vulnerable to malware, viruses, malicious programs, compromise your phone's security features, and may cause the Application to work improperly or not at all.

Third-Party Services

Please note that the Application utilizes third-party services that have their own terms and conditions and privacy policies. The Service Provider may also use third-party providers for hosting, infrastructure, analytics, diagnostics, customer support, storage, content delivery, subscriptions, and AI-powered processing. By using the Application, you acknowledge that your use of those services may also be subject to the applicable third-party terms and policies.

User Accounts and User Content

Certain features of the Application may require you to create an account or submit content, including notes, diary records, maps, measurements, photographs, messages, and other materials ("User Content"). You are responsible for the accuracy, legality, and appropriateness of your User Content and for ensuring that you have all necessary rights, permissions, and consents to submit it.

By submitting User Content through the Application, you grant the Service Provider a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, transmit, display, and otherwise use that User Content solely as necessary to operate, secure, improve, and provide the Application and related services, including AI-powered features.

You must not upload or transmit User Content that:

• infringes the intellectual property, privacy, publicity, or other rights of any person or entity;
• contains unlawful, defamatory, abusive, fraudulent, harmful, or misleading content;
• contains personal data or sensitive information of another person without a valid legal basis or consent; or
• contains malware, malicious code, or material intended to disrupt, damage, or gain unauthorized access to systems or data.

AI Features

The Application may include AI-powered tools and workflows that provide predictions, recommendations, classifications, estimations, generated insights, or similar outputs. These features may use inputs such as time, location, usage signals, user-generated content, photographs, and related metadata in order to produce outputs for your convenience.

Examples of such features may include, without limitation:

• an AI assistant that uses anonymized, aggregated, or pseudonymized fishing-related signals, such as time and geolocation, to generate contextual insights or briefings; and
• fish photo analysis tools that recognize fish species and estimate fish characteristics such as length, width, or weight from anonymous or non-identifying fish images.

AI-generated outputs are provided for informational and convenience purposes only. The Service Provider does not guarantee that any AI-generated output will be accurate, complete, reliable, available, or suitable for your intended purpose. You acknowledge and agree that:

• AI results may be approximate, incomplete, inconsistent, or incorrect;
• you remain solely responsible for reviewing, validating, editing, and deciding whether to rely on any AI-generated output;
• the Application may require an internet connection and third-party processing to provide AI-powered features; and
• the Service Provider may modify, suspend, limit, or discontinue AI-powered features at any time.

Image Content and Fish Recognition

If you use camera, upload, or image-based AI features, you confirm that you have the lawful right to capture, upload, and share the relevant image content. You must not submit images that contain unnecessary personal data or the personal data of other individuals without an appropriate legal basis or consent.

You acknowledge that fish recognition, species identification, and measurement estimation are automated inferences only. They may be used to prefill fields or provide guidance, but they do not replace your own judgment and review.

Consent to AI Processing

By using AI-powered features, you consent to the processing of relevant inputs and metadata as described in the Privacy Policy. If you do not agree to such processing, you must not use the relevant AI-powered features.

Acceptable Use

You agree not to use the Application:

• in any way that violates any applicable law or regulation;
• to attempt unauthorized access to the Application, related systems, or another user's account or data;
• to interfere with or disrupt the integrity, performance, or security of the Application;
• to reverse engineer, scrape, benchmark, or otherwise misuse AI-powered features or outputs except as allowed by applicable law;
• to submit prompts, images, or other content for unlawful, infringing, abusive, deceptive, or harmful purposes.

Internet Connectivity and Device Responsibility

Certain functions of the Application, including AI-powered features, may require an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but the Service Provider cannot take responsibility for the Application not working at full functionality if you do not have access to Wi-Fi and you do not have a data allowance available. If you are using the Application outside of an area with Wi-Fi, you should remember that your agreement with your mobile network provider will still apply and you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the Application, or other third-party charges. In using the Application, you are accepting responsibility for any such charges, including roaming data charges if you use the Application outside of your home territory without turning off data roaming. If you are not the bill payer for the device on which you are using the Application, the Service Provider assumes that you have received permission from the bill payer for using the Application.

Along the same lines, the Service Provider cannot always take responsibility for the way you use the Application. You need to make sure that your device stays charged, secure, compatible, and up to date. If your device, operating system, third-party platform, or app store ceases to support the Application, some or all functionality may stop working.

Availability and Changes to the Service

The Service Provider may wish to update the Application from time to time. The Application is currently available on Android and iOS, but system requirements and feature availability may change. The Service Provider does not promise that it will always update the Application so that it is relevant to you and/or works with the version of Android, iOS, or other software installed on your device. However, you promise to always accept updates to the Application when offered to you, where necessary for continued functionality, security, or compliance.

The Service Provider may also wish to cease providing the Application, specific features, or AI-powered tools and may terminate or suspend their availability at any time without prior notice where reasonably necessary. Unless they inform you otherwise, upon any termination, suspension, or discontinuation: (a) the rights and licenses granted to you in these terms will end with respect to the affected service; and (b) you must cease using the affected service and, if necessary, delete the Application from your device.

Disclaimer of Warranties

The Application is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, the Service Provider disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising out of course of dealing or usage of trade. The Service Provider does not warrant that the Application will be uninterrupted, error-free, secure, or free from harmful components, or that any content or output will be accurate or reliable.

Limitation of Liability

To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business interruption, or other intangible losses, arising out of or related to your use of, inability to use, or reliance on the Application or any AI-generated output, even if advised of the possibility of such damages. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

Subscription and Trial Period

The Service Provider offers access to certain premium features of the Application on a subscription basis. After one year of free access from the date of registration, the Service Provider may transition the Application or specific features to a subscription-based model. You will be provided with a one-month free trial before the subscription begins, unless stated otherwise in the Application or marketplace listing.

At the end of the trial period, you will be automatically charged the applicable subscription fee unless you cancel the subscription before the trial period expires. The Service Provider will clearly inform you of the pricing details and billing cycles before initiating the subscription. If you choose to cancel, you will retain access to free features, but any premium features will become unavailable after the trial or subscription period ends.

Subscription Billing and Renewal

Subscriptions will automatically renew unless canceled at the end of the current billing period. You can manage and cancel your subscription at any time through your account settings in the Application or the mobile app marketplace. No refunds will be provided for unused portions of the subscription period unless required by applicable law or platform rules.

Changes to These Terms and Conditions

The Service Provider may periodically update these Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of material changes by posting the new Terms and Conditions on this page and, where appropriate, through the Application or other reasonable means.
